Terms and Conditions for Electronic Communications and Newsletter

1. Purpose

These Terms and Conditions govern the sending and receipt of electronic communications, newsletters, webinar invitations, events, news, updates, commercial information, and other informational content sent by VITTI LOGISTICS, S. DE R.L. DE C.V. (“VITTI LOGISTICS”) by email or other electronic means.

These provisions apply exclusively to the communications described above and do not replace or modify the terms and conditions applicable to the logistics, commercial, or operational services contracted with VITTI LOGISTICS.

2. Subscription and receipt of communications

People who register to receive communications from VITTI LOGISTICS may receive, according to their preferences and the applicable purpose:

newsletters and periodic publications;

invitations to webinars, seminars, events, and activities;

news and updates related to VITTI LOGISTICS;

information about the company’s services, solutions, or activities; and

other informational or commercial communications related to VITTI LOGISTICS’ activities.

The sending of these communications will be subject to the information provided by the recipient and, where applicable, to the authorizations or consents required by applicable law.

3. Use of personal data

VITTI LOGISTICS may process the personal data provided by recipients to manage registration, administer subscriptions, and send the corresponding communications, in accordance with applicable Mexican data protection legislation.

Personal data will be processed in accordance with VITTI LOGISTICS’ Privacy Notice, available through the applicable electronic medium or website.

Receiving communications does not, by itself, constitute a contract for logistics services and does not constitute a quotation, commercial proposal, binding offer, or commitment to contract.

4. Communication content

Communications sent by VITTI LOGISTICS will serve informational, commercial, or dissemination purposes, as applicable to each communication.

Information contained in newsletters, webinars, publications, articles, presentations, or other materials may be general in nature and should not be interpreted as legal, tax, customs, financial, or other specific professional advice, unless expressly stated otherwise.

When a communication contains information about VITTI LOGISTICS services, the scope, price, availability, and other applicable conditions will be subject to the relevant quotation, commercial proposal, contract, or other document.

5. Accuracy and updating of information

VITTI LOGISTICS will endeavor to ensure that the information disseminated through its communications is clear and reasonably up to date.

However, certain information may change after publication due to regulatory, operational, or commercial changes, or circumstances beyond VITTI LOGISTICS’ reasonable control.

Therefore, the information contained in a communication should be considered based on the date on which it was issued.

6. Links and third-party content

Communications may contain links to websites, platforms, documents, or content managed by third parties.

VITTI LOGISTICS will not be responsible for the content, availability, security, privacy policies, or practices of third parties regarding those websites or platforms.

Access to any third-party content will be at the user’s own responsibility and subject to the applicable terms and conditions of that third party.

7. Intellectual property

Unless expressly indicated otherwise, the content included in VITTI LOGISTICS communications, including text, logos, graphics, images, designs, presentations, and other materials, is owned by VITTI LOGISTICS or lawfully used under the corresponding authorizations.

Content may not be reproduced, modified, distributed, commercialized, or used for purposes other than those permitted by applicable law without the corresponding authorization.

This does not limit the recipient’s right to legitimately share a communication when permitted by applicable law.

8. Communication frequency

The frequency of deliveries may vary depending on the nature of the communications.

VITTI LOGISTICS may send periodic newsletters and additional communications related to webinars, events, news, or specific activities.

The frequency of deliveries does not constitute a commitment to a specific schedule, unless expressly stated otherwise.

9. Unsubscription

The recipient may request at any time to stop receiving informational or commercial communications through the unsubscribe mechanism included in electronic communications or through the contact details provided by VITTI LOGISTICS.

The unsubscribe request will be handled in accordance with applicable law and the corresponding internal procedures.

Unsubscribing from commercial communications will not necessarily entail deleting all of the recipient’s personal data when a legal or contractual obligation, or a legitimate purpose allowing its retention, exists.

Certain communications necessary to comply with legal, contractual, or administrative obligations may also be sent where applicable.

10. Communications received in error

If a person receives a communication from VITTI LOGISTICS by mistake or believes they should not have received it, they may request a review of their registration and, where appropriate, the cancellation of future communications.

VITTI LOGISTICS will take the reasonable actions required to address that request.

11. Legal compliance

VITTI LOGISTICS will endeavor to ensure that its communications comply with applicable legal provisions, including those relating to personal data protection, electronic communications, intellectual property, and any other regulations applicable to the nature of the communication.

The current version will be the version published through the applicable electronic medium.

13. Governing law

These Terms and Conditions will be interpreted in accordance with the applicable laws of the United Mexican States, without prejudice to special provisions applicable to personal data protection and electronic communications.
